South Africa’s National Health Insurance (NHI) is facing one of its most expensive and intense legal battles yet, with the government setting aside a staggering R74 million just to defend the policy in court. The dispute highlights how deeply contested the NHI has become, not just politically, but financially and constitutionally.

Health Minister Aaron Motsoaledi revealed that the state is currently fighting around 15 separate legal cases challenging the NHI framework. Each case reportedly costs between R2 million and R3 million in legal defence, involving senior and junior counsel as well as legal teams working on the government’s behalf.

The upcoming Constitutional Court hearings in May 2026 are expected to be pivotal, especially as key stakeholders like private healthcare bodies and provincial governments argue that the NHI process lacked proper consultation and may be unconstitutional. The government, however, maintains that it is continuing preparations while defending the legislation in court.

Beyond the courtroom drama, the broader stakes are enormous: the NHI remains one of South Africa’s most ambitious healthcare reforms, with billions already allocated in anticipation of its rollout. Yet critics warn that ongoing litigation could delay or reshape the entire system for years.

What’s unfolding is more than a legal dispute—it’s a national debate over the future of healthcare, funding models, and the role of private vs public systems in South Africa. The outcome of these cases could define the country’s healthcare landscape for decades to come.
