Snubbed Acting Principal Triumphs in Fairness Battle

    Bernard Solomons, a dedicated teacher who had been serving as acting principal at Alfons Primary School in the Western Cape for nearly five years, has successfully challenged what he described as an unfair promotional process. After first being shortlisted in 2021, the principal post was left unfilled and later re‑advertised in 2023 — when another candidate, Mr. Muller, was appointed instead despite not having acted in the role as long as Solomons. 

    Solomons argued the decision was unjust, partly because of alleged personal connections between Muller and members of the school governing body, and because his extensive experience was not adequately considered. The Education Labour Relations Council (ELRC) agreed that the Western Cape Education Department failed to apply its mind fully in assessing all evidence and acting fairly. Commissioner LM Taylor ruled the appointment process was both procedurally and substantively unfair, setting aside Muller’s appointment and ordering the post to be re‑advertised to ensure a transparent process open to all qualified applicants. 

    While the ruling didn’t grant Solomons automatic appointment, it underscored that acting experience and unbiased decision‑making must count in promotion decisions — a win for fairness in the workplace.
