As the Western Cape’s Deputy Director of Public Prosecutions, Riley’s testimony plays a crucial role in unpacking the controversial withdrawal of racketeering charges against former Hawks head Johan Booysen.
At the heart of the matter is former National Director of Public Prosecutions Shamila Batohi’s reliance on a panel report—one Riley helped compile—to justify dropping serious charges linked to the Cato Manor unit. Riley acknowledged that the report was not a detailed, case-by-case breakdown of evidence, but rather a summarized analysis of complex dockets.
This admission sparked sharp questioning from Inquiry Chairperson Justice Bess Nkabinde, who suggested that readers of the report may not have received a full and accurate picture of the evidence. Riley agreed that the document lacked a “blow-by-blow” account, raising concerns about whether critical legal decisions were based on incomplete interpretations.
The inquiry itself is investigating the fitness of Advocate Andrew Chauke to hold office, but its scope has broadened into a deeper examination of accountability within the National Prosecuting Authority.
Riley’s testimony highlights a troubling tension: the balance between efficient legal summaries and the need for transparency in decisions that carry significant consequences for justice and public trust.
